1. Agreement
These Terms of Service ("Terms") are a binding agreement between you and [Drivio legal entity name] ("Drivio", "we", "us"), operator of the Drivio mobile application and admin services (the "Platform"). By creating an account or using the Platform you accept these Terms, the Privacy Policy, the Refund & Cancellation Policy, and the Community Guidelines. If you register as a Rider, the Rider Partner Agreement also applies.
Drivio is a technology marketplace. We connect independent transport providers ("Riders") with users seeking transport or vehicle rental ("Customers"). Except where mandatory law provides otherwise, Drivio does not itself provide transport services, does not employ Riders, and is not a party to the transport contract formed between Customer and Rider.
2. The services
The Platform offers three services:
- Standard rides — on-demand bike or car rides. Fare is estimated before booking from distance and platform pricing, and is payable on completion by cash or in-app wallet.
- Pool rides — a Rider publishes a scheduled route with a fixed number of seats at a fixed per-seat price. Customers book seats paid in advance; the Rider may accept or reject each seat request.
- Rentals — a Rider lists a car with hourly rates (fuel-included or self-fuel), minimum/maximum hours, availability. Customers book for a chosen number of hours paid in advance. Bookings for the same day carry a 20% surcharge; next-day is the default.
3. Accounts and eligibility
3.1 You must be at least 18 years old and legally capable of contracting.
3.2 Registration requires a valid mobile phone number verified by one-time password (OTP). You are responsible for the security of your device and for all activity under your account.
3.3 One account may hold both the Customer and the Rider role. The Rider role is inactive until Drivio approves the mandatory verification described in the Rider Partner Agreement (identity document (CNIC), driving licence, vehicle registration, police character certificate, photograph).
3.4 You must provide accurate information and keep it current. We may suspend or terminate accounts that provide false information, misuse the Platform, or violate these Terms.
4. Payments, wallet, commission
4.1 Wallet. The Platform provides an in-app wallet denominated in Pakistani Rupees (PKR). Wallet balances are records of prepaid value usable on the Platform; they are not bank deposits and accrue no interest. Wallet and transaction records are maintained exclusively by Drivio's backend systems; no user can modify them.
4.2 Advance payment and escrow. Pool and Rental bookings are charged to your wallet at booking time and held by the Platform until the service completes. On completion the held amount, minus the platform commission, is released to the Rider.
4.3 Commission. Drivio charges a flat commission of Rs 10 per completed ride (all services). The commission is deducted from the amount released to the Rider (or from the Rider's wallet for cash-settled standard rides).
4.4 Cancellation. Cancellation consequences, including the 20% cancellation deduction on customer cancellation of confirmed pre-paid bookings, are set out in the Refund & Cancellation Policy, which forms part of these Terms.
4.5 Cash rides. For standard rides paid in cash, you pay the Rider directly; the Platform's commission is settled from the Rider's wallet.
4.6 Pricing. Fare parameters are set by Drivio and may change; the applicable price or estimate is always displayed before you confirm a booking.
4.7 Taxes. Amounts may be inclusive or exclusive of applicable taxes as stated at the point of payment. Riders are responsible for their own tax obligations as independent providers.
5. Customer obligations
You agree to: request rides only for genuine use; be present at the pickup point at the agreed time; treat Riders and their vehicles with respect; not carry unlawful goods; not exceed the passenger capacity or the booked seat count; return rental vehicles at the agreed time in the condition received (ordinary wear excepted); refuel per the chosen fuel option for self-fuel rentals; and comply with the Community Guidelines.
For rentals, you must hold a valid driving licence if you will drive the vehicle, and you are responsible for traffic violations and fines incurred during your rental period.
6. Rider obligations (summary)
Riders' full obligations are in the Rider Partner Agreement. In brief: maintain valid licences, registration, and legally required insurance; provide services safely and lawfully; honour accepted bookings; keep listed vehicles roadworthy; and keep KYC information current.
7. Location data, tracking and chat
Providing the services requires processing location data: Customer pickup location, and continuous Rider GPS while online and during trips, which is shared with the matched Customer for live tracking. In-app maps are rendered using Google Maps Platform (Google LLC); the coordinates needed to display pickup, destination, and live rider positions are transmitted from your device to Google for this purpose. In-app chat between the Customer and Rider of an active ride is transmitted and stored by the Platform. Details are in the Privacy Policy.
8. Acceptable use
You must not: (a) attempt to write to, tamper with, or circumvent Platform payment, wallet, or verification systems; (b) reverse engineer, scrape, or overload the Platform; (c) use the Platform for any unlawful purpose; (d) harass, threaten, or discriminate against other users; (e) create accounts with false identities; (f) solicit off-platform payment for platform-originated bookings to evade commission. Violations may result in immediate suspension, forfeiture of pending amounts to the extent permitted by law, and reporting to authorities where required.
9. Intermediary role, disclaimers
9.1 Drivio provides the technology in "as is" condition. To the maximum extent permitted by law, we disclaim warranties of uninterrupted availability, and we are not liable for the acts, omissions, conduct, or vehicle condition of Riders or Customers, who are independent parties.
9.2 Nothing in these Terms excludes liability that cannot be excluded under the laws of Pakistan, including under applicable consumer protection legislation.
9.3 Safety. We require Rider identity verification (including a police character certificate) before activation and provide in-app trip visibility, but we cannot guarantee the conduct of any user. In an emergency, contact local emergency services (Pakistan: 15 police, 1122 rescue) first.
10. Limitation of liability
To the extent permitted by law, Drivio's aggregate liability arising out of the Platform in any 12-month period is limited to the greater of (a) the total commissions we earned from your transactions in that period, or (b) Rs 10,000. We are not liable for indirect or consequential loss, loss of profit, or loss of data.
11. Indemnity
You will indemnify Drivio against claims arising from your breach of these Terms, your violation of law, or (for Riders) the provision of transport/rental services, except to the extent caused by Drivio's own negligence.
12. Suspension and termination
You may stop using the Platform and request account deletion at any time (see Data Retention & Deletion Policy). We may suspend or terminate access for breach, fraud, safety risk, or legal requirement. On termination, undisputed wallet balances are paid out per the Refund & Cancellation Policy; records are retained as described in the Data Retention Policy.
13. Intellectual property
The Platform, its design, code, and content are owned by Drivio or its licensors. You receive a limited, revocable, non-transferable licence to use the app for its intended purpose. Feedback you submit may be used by Drivio without obligation.
14. Changes
We may amend these Terms. Material changes will be notified in-app or by other reasonable means at least 7 days before taking effect; continued use after the effective date is acceptance. The version and effective date appear at the top of this document.
15. Governing law and disputes
These Terms are governed by the laws of the Islamic Republic of Pakistan. Courts at [city of registered office] have jurisdiction, subject to any mandatory consumer forum rights. We encourage you to contact support first — most issues are resolved informally.
